Huawei CFO In Legal Battle With Canada Over Her Arrest

The lawyers, working on behalf of Meng Wanzhou, who is the Chief Financial Officer of Huawei, are looking to sue the government of Canada, the nation’s border agency as well as the federal police. According to allegations put forth by them, their client had been detained, interrogated and searched for nearly three hours, which is in direct violation of the constitutional rights of an individual.

Canada had arrested Ms. Meng on December 1, 2018 in Vancouver, acting on the United States’ request. Consequently, this has brought serious charges against both Meng as well as Huawei Technologies Co of China that have portrayed the company as a potential threat to the national security of the U.S. Meng had been charged with wire as well as bank fraud in violation of American sanctions made against Iran.

Following this fallout, Meng’s lawyers have filed a civil lawsuit on Friday with the Supreme Court of British Columbia. They commented that the way the officers chose to obtain information and evidence from Meng was a serious violation of the Charter of Rights and Freedoms of Canada. Notably, the founder of Huawei is Meng’s father.

Further, it was stated that officers of the CBSA or the Canadian Border Services Agency intentionally chose to delay the instantaneous execution of a warrant for arrest, thereby unlawfully detaining, searching and interrogating Meng with the objective of extracting evidence from her prior to her arrest. According to the lawsuit, the federal police of Canada, which is also known as the Royal Canadian Mounted Police, put the arrest warrant to use three hours later from the time when Meng was unlawfully detained at the airport. There has been no instant response from the RCMP or the justice ministry of Canada. As for the CBSA, they refused to comment on the matter before it was presented in the court.
